These Terms of Service ("Terms") govern access to and use of Handled's websites, software, and related services (collectively, the "Service"). By using the Service, you agree to these Terms on behalf of yourself or the organization you represent.

Acceptance of terms

If you do not agree, do not use the Service. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.

Description of the Service

Handled provides tools for service businesses to follow up on missed calls, manage messaging workflows, capture leads, and related features. Features may change as we improve the product. We describe capabilities on our website and in-product; not every marketing statement is a contractual guarantee.

Accounts

You are responsible for maintaining the confidentiality of credentials and for activity under your account. You must provide accurate information and keep it current. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users.

Acceptable use

You agree not to misuse the Service, including by:

  • Violating applicable law or third-party rights;
  • Sending spam, unlawful bulk messages, or deceptive communications;
  • Attempting to probe, scan, or test the vulnerability of the Service without authorization;
  • Reverse engineering or attempting to extract source code except where permitted by law;
  • Interfering with the integrity or performance of the Service.

Billing and subscriptions

Paid plans, fees, and renewal terms are presented at checkout or in your account. Unless stated otherwise, fees are non-refundable except where required by law. You authorize us and our payment processors to charge your payment method. You may cancel according to the cancellation flow shown in the product or billing settings.

Service availability

We strive for reliable uptime but do not guarantee uninterrupted access. The Service may be modified, suspended, or discontinued with reasonable notice where practicable. Third-party networks (carriers, email providers, etc.) are outside our control.

Third-party services

The Service may integrate with third-party platforms (for example telephony or calendar providers). Your use of those services may be subject to separate terms from those vendors.

Termination

You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms, non-payment where applicable, or to comply with law. Provisions that by their nature should survive termination will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDLED AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.
